Question: Is it legal to geolocate my child with a GPS tracker?

In principle, geolocating your minor child is not prohibited. But this decision must be motivated by the child's own interest. In addition, the parent has the duty to involve him/her, as far as possible according to his/her age.

However, if the parents are separated, this decision must be taken by mutual agreement between them. On the one hand, if parental authority is exercised jointly by the parents, all important decisions concerning the child must be taken jointly. In the absence of an agreement, it will be necessary to refer the matter to the family affairs judge to decide the issue. On the other hand, if the geolocation device is used during the time spent with the other parent, not notifying him or her constitutes a violation of his or her privacy, punishable by a fine and imprisonment under the Criminal Code.
